2009 535i. Same problem - repeated loss of power. I've had the turbo, HPFP, injectors...and even the catalytic converter replaced, all without fixing the problem. Even received the car back from service only to have it fail the very next day and require flabedding to the dealership - twice. I have notified the dealer that I no longer feel safe in the car and want out. They are looking into it with BMW and have extended me the courtesy of a 328i loaner and covered 1 lease payment - all respectable goodwill, but I need a fix to the problem and a car I can trust.

Thank you for a very wonderful job in educating drivers on lemon cars.

Here is another advice for a frustrated driver who has visited auto dealer without a satisfactory solution to his car defects under warranty, you may have a valid claim to get your money back. Law buyers have the to file suit to get their money back on the defective car.

In order to qualify under the lemon law, you must give the repairing dealer a reasonable opportunity to repair the defect. Though no fixed number of repair attempts but four repair attempts is reasonable unless the defect affects your safety. In that case, two repair attempts may be sufficient.

The defects must substantially affect the vehicle's use, value or safety.

The buyer's remedies are either a new replacement, return of the purchase price and finance charges, or a partial refund.

Own a 2008 535i: 20K miles.
Second trip to dealer for the second week. Both times accelerating from a freeway on ramp.
Engine trouble: reduced speed msg turns on. The car makes it to the BMW service. First time they told me it was a kink in a hose. Second time they said it is the turbos need to be replaced...
So far they are telling me 2 weeks to replace the turbos because BMW stores these parts in NY...

I don't know what to do. My car has been in the shop for over a month this year so far.
any suggestions?
