			<content:encoded><![CDATA[<p>1790.1.  Any waiver by the buyer of consumer goods of the provisions<br />
of this chapter, except as expressly provided in this chapter, shall<br />
be deemed contrary to public policy and shall be unenforceable and<br />
void.</p>
<p>1790.2.  If any provision of this chapter or the application thereof<br />
to any person or circumstance is held unconstitutional, such<br />
invalidity shall not affect other provisions or applications of this<br />
chapter which can be given effect without the invalid provision or<br />
application, and to this end the provisions of this chapter are<br />
severable.</p>
<p>1790.3.  The provisions of this chapter shall not affect the rights<br />
and obligations of parties determined by reference to the Commercial<br />
Code except that, where the provisions of the Commercial Code<br />
conflict with the rights guaranteed to buyers of consumer goods under<br />
the provisions of this chapter, the provisions of this chapter shall<br />
prevail.</p>
<p>1790.4.  The remedies provided by this chapter are cumulative and<br />
shall not be construed as restricting any remedy that is otherwise<br />
available, and, in particular, shall not be construed to supplant the<br />
provisions of the Unfair Practices Act</p>

<p>Officially the Song-Beverly Consumer Warranty Act, better known as the California Lemon Law, was a huge boost for automobile and vehicle buyers.  This law in California states that is a vehicle manufacturer is unable to fix the vehicle you purchased to abide by the warranty, and then they have to give you the purchase price or replace the vehicle with a new one.  When you are working with a law like this in California, it’s truly amazing because it states that if you prove you have a lemon vehicle then you can choose if you would prefer your money back or a new replacement vehicle of the same make and model.</p>
<p>The California Lemon Law, if you qualify, will not only make the manufacturer give you your money back or give you a new vehicle, but it will also make them refund the consumer sales tax, license, registration, rental car feels, towing and finance charges.  The one expense, under this California law that the consumer may be charged is for vehicle usage which is calculated by using the actual price of the vehicle as the denominator and the exact miles that was used before the problem was discovered as the numerator.  When you realize that you probably have a lemon, there are many things that you need to learn about this law.</p>
